Some Good News

We needed this important victory in a hideous week, so far. The spineless Democratic (I use the term loosely) senators in Washington should take a lesson from the Democrats in the Wisconsin Assembly. Good for the representatives. They did the right thing, again.

"The state Assembly today came up short in its attempt to override Gov. Jim Doyle’s veto of a measure that would have allowed residents to carry concealed weapons.

The 64-to-34 vote was a boost to Doyle, who mustered enough support from fellow Democrats to fend off a veto override on the measure for a second time."

'This shows muscle contains infected material,' said senior author Glenn Telling, an associate professor of microbiology at the University of Kentucky. 'Anybody who may be handling or eating infected deer may be inadvertently exposed.'"

I was in Trinidad once. &, dear SideKick, no. Here was a man who did good in the world, & he ought to be appreciated.

"As a physician and general surgeon in the remote southern Colorado town of Trinidad, Dr. Stanley Biber treated the usual sore throats and broken arms and did his share of delivering babies, removing appendixes and replacing hips and knees.

Biber, who died of complications of pneumonia in a Pueblo hospital Monday at age 82, was known for turning tiny Trinidad into the 'Sex-Change Capital of the World.'"

Money talks, even to "prestigious" professors. Oregon State ought to be ashamed. But they won't be. The logging interests will take them out to a very nice dinner.

The President's men have minced words about America's laws. The Attorney General openly conceded that the 'kind of surveillance' we now know they have been conducting requires a court order unless authorized by statute. The Foreign Intelligence Surveillance Act self-evidently does not authorize what the NSA has been doing, and no one inside or outside the Administration claims that it does. Incredibly, the Administration claims instead that the surveillance was implicitly authorized when Congress voted to use force against those who attacked us on September 11th.

This argument just does not hold any water. Without getting into the legal intricacies, it faces a number of embarrassing facts. First, another admission by the Attorney General: he concedes that the Administration knew that the NSA project was prohibited by existing law and that they consulted with some members of Congress about changing the statute. Gonzalez says that they were told this probably would not be possible. So how can they now argue that the Authorization for the Use of Military Force somehow implicitly authorized it all along? Second, when the Authorization was being debated, the Administration did in fact seek to have language inserted in it that would have authorized them to use military force domestically -- and the Congress did not agree. Senator Ted Stevens and Representative Jim McGovern, among others, made statements during the Authorization debate clearly restating that that Authorization did not operate domestically."

The spy agency was collecting much of the data by eavesdropping on some Americans' international communications and conducting computer searches of foreign-related phone and Internet traffic. Some F.B.I. officials and prosecutors also thought the checks, which sometimes involved interviews by agents, were pointless intrusions on Americans' privacy.

"We'd chase a number, find it's a schoolteacher with no indication they've ever been involved in international terrorism - case closed," said one former F.B.I. official, who was aware of the program and the data it generated for the bureau. "After you get a thousand numbers and not one is turning up anything, you get some frustration."

F.B.I. field agents, who were not told of the domestic surveillance programs, complained that they often were given no information about why names or numbers had come under suspicion. A former senior prosecutor who was familiar with the eavesdropping programs said intelligence officials turning over the tips "would always say that we had information whose source we can't share, but it indicates that this person has been communicating with a suspected Al Qaeda operative." He said, "I would always wonder, what does 'suspected' mean?"

"The information was so thin," he said, "and the connections were so remote, that they never led to anything, and I never heard any follow-up."

Sen. Kay O'Connor, R-Olathe, said she was disappointed by the report.

"There's no way I'm going to support that report," she said. "I fully expected to have a lot of information to use. I was anxious when they figured out the cost of education they would find out how the private-sector schooling handles things."

O'Connor, who represents De Soto, said while she didn't have any specific examples of public-sector funding being out of line, she wanted the study to look into public school expenditures not related to education.

"They did not address the issue that swimming pools and sports stadiums and Arizona dirt are not mandated by either the constitution or the statutes," she said, referring to a new stadium in Olathe. "We do have a statutory requirement of physical education, so they might say that was required, but apparently this was not even addressed."

O'Connor said she wouldn't support any new tax increases for education.

"We are spending like crazy, and we're building a deficit," she said. "We have got to learn to live within our means, and if that means we can't bring in dirt from Arizona, so be it."

She criticized the Olathe district for giving money for temporary living for children and other expenses.

"How many times have we heard public schools are giving money to their local chambers of commerce?" she asked. "It may not be against the law, but it's not statutorily required. This kind of expense was totally ignored."

Jan. 2, Ali N. Vogel, 20, Grantsburg, was seriously hurt after she lost control on County Road F due to heavy ice and slush on the road. The vehicle skidded into the ditch and landed on the roof on top of the swamp. The occupants escaped through a broken rear window. It’s unknown which hospital she’s currently at.
